Terms And Conditions
TERMS AND CONDITIONS
Effective Date: March 6, 2026.
Website: https://www.skjgrading.com
Operator: SKJ Authentications LLC, a California limited liability company, doing business through Skjgrading.com.
1. Acceptance of Terms
These Terms and Conditions govern access to and use of the website identified above, together with any related ordering interface, submission forms, communications, grading services, authentication services, encapsulation services, regrading services, and related offerings made available by SKJ Authentications LLC, referred to in these Terms as “SKJ,” “we,” “us,” or “our.” By visiting the website, creating an account, submitting an order, shipping any item to SKJ, paying an invoice, or otherwise using any service, the customer, submitter, account holder, or visitor, referred to as “you” or “your,” agrees to be bound by these Terms.
Use of the services is permitted only by persons who can form binding contracts under applicable law. California law recognizes consent, lawful object, and consideration as essential elements of contract formation, and your submission of an order or use of the website is intended to constitute acceptance on that basis. If you are acting on behalf of another person or business entity, you represent that you possess authority to bind that person or entity to these Terms.
2. Nature of the Services
SKJ provides card-grading and related evaluation services for sports cards, trading card game cards, and certain autograph-related items accepted by SKJ in its sole discretion. Services may include visual and technical review, condition assessment, authenticity opinions where offered, encapsulation, labeling, imaging, order tracking, customer support, and regrading or review services where available.
A grade, subgrade, designation, authenticity conclusion, or similar service output constitutes SKJ’s professional opinion as of the date of examination. It is not a guarantee of future market value, investment performance, resale price, insurability, merchantability, or collectability. Card surfaces, edges, centering, corners, print quality, manufacturing defects, restoration, trimming, pressing, cleaning, alteration, autograph characteristics, and other item attributes may involve judgment calls. Reasonable experts may differ. Accordingly, the services are opinion-based and not infallible.
3. Eligibility, Account Accuracy, and Submission Authority
You represent and warrant that all information submitted to SKJ is accurate, current, and complete. Any person sending an item to SKJ further represents that the person has lawful title to the item, or express authorization from the lawful owner to submit it for grading, authentication, encapsulation, shipment, storage, and handling under these Terms.
Orders may be refused, suspended, or cancelled where submitted information is inaccurate, the item appears prohibited, counterfeit, unlawfully possessed, improperly packaged, contaminated, unsafe to handle, or inconsistent with SKJ’s submission requirements. SKJ may also decline any order where the item category falls outside its then-current service scope.
4. Submission Procedures
You are responsible for reviewing all posted submission instructions before shipping any item. Each order must accurately identify the item, declared service level, declared value where requested, shipping information, and any additional information reasonably required by SKJ for intake and processing.
Inbound shipping to SKJ is entirely your responsibility. You bear sole responsibility for packaging, labeling, tracking, insurance, customs compliance, declared values, and carrier selection for shipments sent to SKJ. Risk of loss during transit to SKJ remains with you until the shipment is actually received and logged by SKJ at its facility.
SKJ may reject, quarantine, or return packages that arrive in damaged condition, are inadequately packaged, contain undisclosed contents, or otherwise create operational or safety concerns. Processing times commence only after actual receipt, intake, and confirmation that the submission satisfies SKJ’s requirements.
5. Turnaround Times
SKJ’s current standard turnaround target is approximately ten business days, measured Monday through Friday, excluding federal holidays, carrier interruptions, force majeure events, unusually high submission volume, quality-control holds, fraud-prevention review, payment issues, or circumstances outside SKJ’s reasonable control.
Any turnaround time posted on the website, quoted in customer communications, or associated with a service tier is an estimate only. It is not a fixed deadline, essential term, or guarantee. Delays do not, by themselves, entitle you to cancellation, compensation, chargeback rights, or refund, except where non-waivable law requires otherwise.
6. Fees, Taxes, Payment, and Invoicing
You agree to pay all grading fees, authentication fees, review fees, encapsulation fees, return-shipping charges, insurance charges, handling fees, applicable taxes, duties, and any other disclosed amounts associated with your order. SKJ may require prepayment, partial payment, or payment in full before commencing work, before releasing results, before return shipment, or at any other commercially reasonable stage of the transaction.
Failure to make timely payment constitutes a material breach. SKJ may suspend services, withhold completed items, decline future orders, assess reasonable storage or collection-related charges where permitted by law, and exercise any lawful possessory or contractual remedy available to it.
Where the website later offers subscription, membership, or automatically renewing plans, any such offer to California consumers must comply with California Business and Professions Code § 17602, including clear disclosures and an acknowledgment mechanism meeting statutory requirements.
7. Results, Visibility of Grades, and Release of Information
SKJ presently intends that grading results will not be visible to customers until the graded items have been shipped back to the customer. SKJ may, however, use internal records, photographs, serial identifiers, and order data for quality control, fraud prevention, insurance support, customer-service handling, archival purposes, and legal compliance.
You acknowledge that labels, serial numbers, holder data, and item descriptions may become part of SKJ’s business records. Subject to applicable privacy commitments, SKJ may retain and use such records to verify past submissions, address disputes, support authenticity checks, combat fraud, and maintain operational integrity.
8. Shipping, Risk Allocation, and Custody
After SKJ has accepted your item into its possession for processing, SKJ will exercise reasonable care in handling and storing the item while it remains in SKJ’s custody. During the grading period and while the item is in SKJ’s possession, SKJ accepts responsibility for loss or physical damage to the item to the extent caused by SKJ’s failure to use reasonable care, subject to the liability limitations set out in these Terms.
Outbound return shipping will be arranged by SKJ using USPS unless SKJ states otherwise. Shipping charges for return delivery are your responsibility. Once SKJ tenders the completed order to the outbound carrier, title and risk of transit loss pass to you, except to the extent a non-waivable law provides otherwise or loss arises from SKJ’s proven misdelivery inconsistent with your confirmed shipping instructions.
You are responsible for ensuring that your delivery address is accurate and secure. SKJ shall not be liable for delivery delays, porch theft, customs holds, routing errors by the carrier, or similar events occurring after carrier acceptance, except to the extent directly caused by SKJ’s incorrect labeling contrary to the order information you approved.
9. Regrading and Review of Disputed Grades
Because grading is opinion-based, disagreement with a grade does not establish error, negligence, or breach. SKJ may offer a regrading or review service for customers who dispute the assigned grade. Any such review must be requested through SKJ’s then-current procedure, accompanied by the applicable review fee, and submitted within any deadline posted by SKJ or stated in the order materials.
A regrading request does not guarantee a grade change. Upon review, the grade may remain the same, increase, or decrease. Submission of an item for regrading constitutes consent to whatever revised opinion SKJ assigns after that review. Except where SKJ expressly states otherwise in writing, regrading fees are non-refundable.
10. No Refunds and Return Policy
All submitted services are final, and SKJ maintains a no-refund and no-return policy once an order has been accepted for processing, because the service involves individualized examination, handling, labor allocation, and item-specific evaluation. No refund shall be due merely because you disagree with a grade, dislike an authenticity conclusion, decide not to proceed after shipment has been received, or experience delay within a commercially reasonable range.
Notwithstanding the foregoing, any refund rights that cannot lawfully be disclaimed under applicable consumer-protection law remain reserved. Where a refund is required by non-waivable law, SKJ may elect, to the extent legally permissible, to provide the minimum remedy required under that law.
Refund requests, where legally available, must be submitted in writing to info@skjgrading.com within fourteen calendar days after the event giving rise to the request, must identify the order number and the precise legal and factual basis relied upon, and must include supporting documents. Failure to provide timely and complete documentation may result in denial of the request.
No return of a submitted item will be accepted as a substitute for a refund remedy, because customer property is ordinarily returned only through the fulfillment and shipping process tied to the completed order.
Personalized labels, encapsulated items, digitally delivered reports, review outcomes, and completed authentication or grading opinions are excluded from refund eligibility except where mandatory law requires otherwise. To the extent any written warranty is expressly issued in connection with a tangible product supplied by SKJ, such warranty will be governed by its own terms and by applicable law, including, where legally applicable, the Magnuson-Moss Warranty Act, 15 U.S.C. §§ 2301 to 2312. SKJ does not, by default, issue a general written consumer-product warranty through these Terms alone.
11. Unpaid Orders, Storage, and Deemed Abandonment
Any order that remains unpaid for ninety calendar days after completion may be treated by SKJ as unclaimed to the fullest extent permitted by applicable law. “Completion” means the stage at which grading and related services for the order have been finished and the order is ready for release, invoicing, or shipment.
Before taking action under this section, SKJ may attempt notice using the contact information associated with the order. If payment remains outstanding after the applicable period, SKJ may, to the fullest extent permitted by law, retain possession of the item, suspend release, and charge reasonable storage-related amounts where lawful.
Where applicable law permits additional remedies with respect to unclaimed property or unpaid charges, SKJ reserves the right to exercise those remedies only after compliance with any notice and procedural requirements imposed by law.
12. Declared Value and Limitation of Liability
You are responsible for declaring an accurate value for each item whenever SKJ requests one. SKJ may rely on the declared value for insurance, service-level assignment, internal risk management, and any limitation-of-liability analysis under these Terms. An intentionally inaccurate declared value may limit recovery, delay processing, void optional coverage, or result in rejection of the order.
To the fullest extent permitted by law, SKJ’s aggregate liability arising from or relating to any item, order, or service shall not exceed the lesser of, first, the item’s declared value accepted by SKJ for that order, or second, the amount of direct, proven loss caused by SKJ’s failure to exercise reasonable care. Consequential, incidental, indirect, punitive, exemplary, and special damages are excluded, including loss of market opportunity, loss of speculative value, diminution based on third-party market reaction, emotional distress, reputational harm, and attorney’s fees, except where a statute expressly forbids such limitation.
No action may be maintained against SKJ for ordinary disagreement with a grade, authenticity opinion, or descriptive terminology, absent clear proof of bad faith, fraud, or another non-disclaimable legal basis.
13. Disclaimer of Warranties
To the fullest extent permitted by law, the website and services are provided on an “as is” and “as available” basis. SKJ disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing, course of performance, or trade usage.
No oral statement, informal communication, social-media post, marketing content, or customer-service response shall create any warranty unless contained in a formal written instrument signed by an authorized representative of SKJ.
14. Website Use and Prohibited Conduct
You may not use the website or services for any unlawful, fraudulent, abusive, or unauthorized purpose. Prohibited conduct includes submitting stolen or counterfeit property, interfering with website security, attempting unauthorized access, scraping or harvesting data without written consent, uploading infringing or defamatory material, introducing malicious code, misrepresenting identity, initiating abusive chargebacks, or using SKJ’s name, labels, serial data, or images in a deceptive manner.
SKJ may suspend access, cancel orders, preserve records, and cooperate with law enforcement or rights holders where reasonably necessary to investigate suspected misconduct or comply with legal obligations.
15. Intellectual Property
All content on the website, including text, branding, logos, graphics, layouts, photographs, software, databases, labels, holder designs, and service descriptions, together with the selection and arrangement thereof, is owned by SKJ or its licensors and is protected by copyright, trademark, and other applicable laws. No ownership interest is transferred to you by virtue of website access or service use.
Subject to these Terms, SKJ grants you a limited, revocable, non-exclusive, non-transferable license to access and use the website solely for personal or internal business use related to lawful transactions with SKJ. Reproduction, republication, public display, commercial exploitation, reverse engineering, or derivative use is prohibited without prior written consent.
You retain ownership of the content and items you lawfully submit, but you grant SKJ a non-exclusive, worldwide, royalty-free license to photograph, scan, digitize, reproduce, store, display, and use submitted item images and related metadata for order fulfillment, grading records, anti-fraud controls, archival purposes, marketing of completed services in de-identified or item-identified form, and legal compliance, unless prohibited by a separate written agreement.
16. Copyright Complaints
SKJ respects intellectual-property rights and expects users to do the same. If you believe that content appearing on or through the website infringes your copyright, trademark, or other intellectual-property rights, you may send a written complaint to info@skjgrading.com. Any complaint should identify the work, mark, or material at issue, the allegedly infringing content and its location, your contact information, the basis of your claim, and any supporting documentation reasonably necessary to permit review.
Copyright complaints must be sent to:
Email: info@skjgrading.com
Upon receipt of a complaint, SKJ may investigate the matter, request additional information, remove or restrict access to the challenged material, or take any other action it considers appropriate in light of the circumstances and applicable law. SKJ reserves the right to suspend or terminate access by users who repeatedly post or submit material that infringes the rights of others.
17. Electronic Communications and Signatures
By using the website or services, you consent to receive communications from SKJ electronically, including invoices, status notices, policy updates, and legally required disclosures, to the extent permitted by applicable law. You agree that electronic records and signatures may satisfy legal requirements for writings and signatures under the Electronic Signatures in Global and National Commerce Act, 15 U.S.C. § 7001, except where that statute requires additional consumer consent procedures for particular categories of records.
18. Governing Law and Dispute Resolution
These Terms, and any dispute arising out of or relating to the website, the services, or any order, shall be governed by the laws of the State of California, without regard to conflict-of-laws rules, except where federal law controls or non-waivable consumer law of your place of residence applies.
Any dispute not resolved informally shall be brought exclusively in the state or federal courts located in California, and each party irrevocably submits to that venue and jurisdiction, unless a non-waivable law requires another forum. Before filing suit, the complaining party shall provide written notice describing the dispute in reasonable detail and allow at least thirty days for good-faith discussions.
For consumers residing in the European Union, SKJ notes that the European Commission’s Online Dispute Resolution platform was discontinued on July 20, 2025. Complaints may instead be directed to SKJ using the contact details provided on the website or to any competent consumer-protection authority or alternative-dispute-resolution body that may be available in the consumer’s jurisdiction.
19. Force Majeure
SKJ shall not be liable for failure or delay resulting from causes beyond its reasonable control, including carrier disruption, internet outage, cyber incident, labor interruption, natural disaster, fire, flood, governmental action, epidemic, supply shortage, civil unrest, utility failure, or other force majeure event. Performance time shall be extended for the duration of the event and any commercially reasonable recovery period.
20. Modifications to the Terms
SKJ may amend these Terms from time to time by posting an updated version on the website. The revised Terms become effective upon posting, unless a later date is stated. For orders already accepted before an amendment, the version in effect at the time of order acceptance will ordinarily govern that order, unless the amended version is required by law or is accepted by you thereafter.
21. Severability, Waiver, and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force to the maximum extent permitted by law. No waiver by SKJ shall be effective unless made in writing, and no waiver of any breach shall operate as a waiver of any later breach.
These Terms, together with any submission forms, order confirmations, pricing schedules, service descriptions, and other documents expressly incorporated by reference, constitute the entire agreement between you and SKJ concerning the subject matter addressed here, and they supersede prior discussions, statements, and understandings relating to that subject matter.
